This Privacy Policy explains how SmartPass AI(“SmartPass,” “we,” “us,” or “our”) collects, uses, and protects your information when you use our website at smartpassnursing.com and related applications (the “Service”), an online study platform for the NCLEX-RN® and the Philippine Nurse Licensure Examination (PNLE). By using the Service, you agree to this Policy.
1. Information We Collect
- Account information — your name, email address, and password (or, if you sign in with Google, your Google account email and basic profile).
- Profile & preferences — chosen exam (NCLEX-RN or PNLE), target exam date, and study settings.
- Study & performance data — questions you answer, scores, readiness results, mock-exam results, study streaks, flashcard progress, and similar usage activity.
- Content you create — notes and files you upload (including PDFs), flashcards, and forum posts.
- Payment information — if you subscribe, billing is handled by our third-party payment processor; we do not store full card numbers on our servers.
- Technical data — device, browser, IP address, and log data, collected via cookies and similar technologies to keep you signed in and to operate the Service.
2. How We Use Your Information
- Provide, maintain, and personalize the Service (e.g., adaptive practice, readiness scoring, and study recommendations).
- Process subscriptions, trials, and payments.
- Send transactional and account-related communications (e.g., verification, receipts, and important notices).
- Improve our content, features, and performance, and keep the Service secure.
- Comply with legal obligations and enforce our Terms.
3. AI Features
Some features (such as the AI tutor and answer rationales) send the text of your question or request to a third-party AI provider to generate a response. Do not submit sensitive personal information, real patient information, or confidential data into AI features. AI-generated content may be inaccurate and is provided for study purposes only — see our Terms of Service.
4. Service Providers We Use
We rely on trusted third parties to operate the Service, and share information with them only as needed:
- Supabase — authentication and database hosting.
- Vercel — application hosting and delivery.
- Google — optional “Sign in with Google” authentication.
- AI provider (via OpenRouter) — generating tutor responses and rationales.
- Email provider — sending verification and account emails.
- Payment processor — processing subscriptions and trials.
- YouTube — relevant educational videos are surfaced from publicly available content; viewing them is subject to YouTube/Google’s own terms and privacy policy.
5. How We Share Information
We do not sell your personal information. We share it only with the service providers above (to operate the Service), when required by law or to protect rights and safety, or in connection with a business transfer (e.g., merger or acquisition).
6. Cookies
We use cookies and local storage to keep you signed in, remember preferences, and operate the Service. You can control cookies through your browser settings, but some features may not work without them.
7. Data Retention
We keep your information for as long as your account is active or as needed to provide the Service and meet legal obligations. You can clear your study/performance data anytime in Settings → Reset Progress, or request account deletion (see “Your Rights”).
8. Security
We use reasonable technical and organizational measures to protect your information (including encrypted connections and access controls). No method of transmission or storage is 100% secure, so we cannot guarantee absolute security.
9. Your Rights & Choices
- Access, update, or correct your account information in your profile settings.
- Reset your study and performance data in Settings.
- Request deletion of your account and associated personal data by contacting us.
- Unsubscribe from non-essential emails using the link in those emails.
Depending on your location, you may have additional rights under laws such as the Philippine Data Privacy Act, the GDPR, or the CCPA.
10. Children’s Privacy
The Service is intended for nursing students and professionals and is not directed to children under 13 (or the minimum age required in your jurisdiction). We do not knowingly collect information from such children.
11. International Transfers
Your information may be processed in countries other than your own. Where required, we take steps to ensure your information receives appropriate protection.
12. Changes to This Policy
We may update this Policy from time to time. Material changes will be posted here with a new “Last updated” date, and where appropriate we will notify you.
